The Tillery family is proud to announce the Tillery Preferred Owner’s Reward Program. The following document details the terms and conditions of Tillery Preferred Owners Reward Program.
 
Tillery Preferred Owner program members will receive incentive dollars for every dollar spent on vehicle purchases, parts and service at our dealerships. We are a full-service maintenance and repair center. As an authorized GM Dealer our customers are assured of the availability of Genuine GM Parts for all vehicle maintenance and repair needs.
 
Overview of Preferred Owner Program
 
1.                   The Tillery Preferred Owner Program is a loyalty program sponsored by the Tillery dealerships that allows owners to earn incentive dollars toward future vehicle, service, parts and accessory purchases. Acquisitions include new and used vehicle purchases, service labor and parts/accessories from both Tillery dealerships up to a maximum of $300.00 in any one transaction.
2.                   All earned reward dollars can be used only for retail purchases at Tillery Chevrolet GMC and Tillery Buick GMC ONLY.
 
Program Rules
 
  1. Incentive dollars cannot be redeemed for cash.
  2. Any items purchased through the Preferred Owners Program cannot be returned for cash. All returned items’ value will be applied to the Preferred Card. No exception.
  3. Award dollars will not expire (unless Dealership terminates the program) but rewards cards will expire within 24 months. Cards may be reissued by visiting the issuing store and dollars may be transferred to new card.
  4. Dealership reserves the right to terminate the program at any time.
  5. Award dollars cannot be used in conjunction with other specials and coupons.
  6. Your Preferred Card can be used for any vehicle in your household.
  7. Award dollars can only be earned on cash purchases. You cannot accrue dollars on warranty, insurance or extended warranty purchases.
  8. Parts/Service dollars may be redeemed for purchase of parts and accessories, service labor and vehicle purchases, up to the maximum of $300 redeemed in any one transaction.
  9. Sales dollars may ONLY be redeemed for vehicle purchases, up the maximum of $300 redeemed in any one transaction.
 
Earning Program Dollars
 
  1. When you first enroll in the Program, the Preferred Owner will receive a Tillery Preferred Owner Rewards Card. The card is to be used for each eligible transaction.
  2. Incentive dollars can be earned in the following manners:
a.               Retail vehicle purchase earns $100 toward a future vehicle purchase and $25 toward future service, parts or accessory purchase;
b.                Each service event (parts and labor) earns 3% of total dollars spent (less tax) towards a future service, parts or accessory purchase;
c.                 Each parts and/or accessory purchase earns 3% of total dollars spent (less tax) towards a future service, parts or accessory purchase.
   
Participation in the Program
 
1.          The Program is available to all Tillery customers who are over the age of 18.
2.        Tillery employees are eligible to participate in the Program.
3.          Fleet or wholesale customers are not eligible to participate in the Program.
4.          Participation in the Program constitutes each Preferred Owner’s full and unconditional agreement to these Terms and Conditions.
5.          The personal information that is collected from each customer in connection with the Program will be used in accordance with the Tillery and GM Privacy Policies.
 
 
General Terms and Conditions
 
1.       Tillery Chevrolet GMC and Tillery Buick GMC may modify any of the terms and conditions governing the Program – including, but not limited to, the methods through which incentive dollars can be earned, how the Program can be used, the value of the earned dollars, at any time, without notice, even though these changes may affect the Reward Owner’s ability to use the dollars that have already been earned.
2.         The Program has no pre-determined termination date and may continue until such time that Tillery may terminate the program at any time, with no notice given.
3.         Accrued Preferred Owner Reward dollars do not constitute property of a Reward Owner and have no value outside of the program. Program Owner dollars are credits that Tillery Chevrolet GMC and Tillery Buick GMC may revoke at any time as set forth herein. Reward points may not be exchanged for cash, assigned, bartered or transferred except as matter or otherwise by operation of law.
4.         Each Program Member is responsible for ensuring that the information in his/her account is accurate and kept current.
5.         These Terms and Conditions are governed by and interpreted under the laws of the State of New Mexico, U.S.; as such laws are applied to agreements entered into and to be performed entirely within New Mexico by New Mexico residents. These Terms and Conditions and any documents it incorporates set forth the entire understanding between the parties with respect to the subject matter hereof.
6.         Abuse of the Preferred Owner Program (including failure to follow program policies and procedures, the sale or barter of awards and any misrepresentation of fact relating thereto or other improper conduct, as determined by Dealer in its' sole judgment, any untoward or harassing behavior with reference to any Dealer employee or any refusal to honor Dealer employee's instructions) may result in cancellation of the member's account and future disqualification from program participation, forfeiture of all dollars accrued.  Dealer reserves the right to take appropriate legal action, as it deems necessary, and to recover damages, attorney's fees and court costs.
 
 
7.         Limitation of Liability governs that each Program member accepts all responsibility for and hereby indemnifies and holds harmless Tillery Chevrolet GMC, Inc, and Tillery Buick GMC, LLC and each of their related companies (General Motors) and respective owners, officers, directors, employees, shareholders, agents and successors and assigns from and against any claims that may arise from actions taken by such Member or for any unauthorized access to Preferred Owner’s account from a third party. Under no circumstances, including but not limited to negligence, shall the Released Parties be liable for any direct, indirect, incidental, special or consequential damages arising out of the program. By participating in the Program, a Rewards Member waives any and all rights to bring any claim or action related to such matters in any forum beyond one (1) year after the first occurrence of the kind of act, event, condition or omission upon which the claim or action is based.
 
8.         If any provision of these Terms and Conditions is found to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be severed from the remainder of these Terms and Conditions, which will otherwise remain in force.
